New Mexico Healthcare Bill Signed into Law

On March 6, 2026, Gov. Michelle Lujan Grisham signed House Bill 38 (HB 38) into law. 

The bill requires group health benefit plans to provide coverage for prosthetic devices, custom orthotic devices, and complex rehabilitation technology devices that are at least equivalent to that coverage currently provided by the federal Medicare program and no less favorable than the terms and conditions that the plan offers for medical or surgical benefits. Coverage of complex rehabilitation technology devices includes manual or power wheelchairs that are designed for a specific individual’s medical needs, provided certain requirements are met. 

These provisions apply to policies, plans, contracts, and certificates delivered or issued for delivery or renewed, extended, or amended in this state on or after January 1, 2027. 

Employers that sponsor group health benefits regulated by the state should be aware of this upcoming change and should contact their carriers for further information.
