New Mexico Issues Bulletin on Coordination of Benefits for Minor Children

On November 17, 2025, the New Mexico Office of the Superintendent of Insurance (OSI) released Bulletin 2025-015 regarding coordination of benefit (COB) provisions for minor children.

The bulletin explains OSI’s position regarding allowable coordination of benefits provisions for a dependent child covered under more than one health insurance plan. OSI will accept coordination of benefits language consistent with NAIC’s Coordination of Benefits Model Regulation, Section 6(D)(2). The bulletin outlines how the order of benefits is determined for dependent children whose parents are married or living together and for dependent children whose parents are divorced or separated or are not living together, including where a court decree may assign responsibility for coverage of the dependent child’s healthcare expenses.

Although the bulletin is directed at insurers offering major medical, dental or vision coverage in the state, employers that sponsor fully insured plans issued in the state may want to be aware of the content. Employers should contact their carrier if they have questions regarding how the bulletin applies to their policy.
