October 20, 2021 Webinar Archive: Transparency and No Surprises Act: Compliance Considerations for Group Health Plans

The Transparency in Coverage final rule and the Consolidated Appropriations Act of 2021, both passed in late 2020, have imposed significant new compliance obligations upon group health plan sponsors. Join us as we discuss compliance considerations under these recent federal laws. We will begin the presentation with an overview of the transparency requirements, including data disclosures and cost-sharing tools required, along with their applicable effective dates. We will then discuss the No Surprises Act, which imposes surprise billing prohibitions and additional transparency and disclosure requirements. We will also review subsequent regulatory guidance regarding the implementation and enforcement of these provisions. By the end of this presentation, participants should better understand compliance obligations related to these new requirements and action items for group health plan sponsors.

Diane joined NFP in 2019 to educate, consult, and problem-solve on issues related to health and welfare benefits. Most recently, Diane advised employers on matters related to employee benefits compliance for a regional insurance brokerage, helping employers achieve and maintain compliance with local, state, and federal laws. She has experience consulting on issues related to ERISA, HIPAA, COBRA, Section 125, PPACA, among other regulations, as well as advising on rules related to HSAs, FSAs, HRAs, and other matters impacting employee benefits administration. Diane earned her Bachelor of Science from Butler University and her Juris Doctor from Florida Coastal School of Law. She is a member of the Indiana bar.

Carol joined NFP in 2019 to provide guidance to employers, consultants and brokers regarding employee benefit regulatory and compliance concerns. With the other team members, she works to ensure clients are provided with the resources and information to address complex benefit challenges and stay ahead of industry developments. Prior to joining NFP, Carol served as associate counsel at HSA Bank, which provides consumer directed healthcare custodial and administrative services. In this role, she addressed compliance and contractual issues regarding HSAs, FSAs, HRAs and COBRA. She also worked as an attorney at Pentegra Retirement Services, where she focused upon ERISA, tax and fiduciary matters involving defined contribution and defined benefit plans. Carol earned a Bachelor of Arts and Juris Doctor from St. John’s University and St. John’s University Law School in New York. She is a member of the State Bars of New York and Connecticut.
