OSHA Publishes Guidance on Employer Vaccine Mandate

On November 4, 2021, the DOL’s Occupational Safety and Health Administration (OSHA) published its long-anticipated emergency temporary standard (ETS) relating to the Biden Administration’s employer COVID-19 vaccine mandate.

The mandate requires employers with 100 or more employees to ensure all employees are vaccinated or are tested weekly. According to the ETS, while the mandate’s effective date is November 5, 2021, employees will have until January 5, 2022, to be fully vaccinated.

The ETS addresses many questions that employers have contemplated since the mandate was announced by the Biden Administration in September 2021. We have summarized the ETS guidance on the most pressing employer questions in our FAQ document.
