On June 25, 2015, Commissioner of Insurance Kipper issued Bulletin 15-002, communicating the position of the Division of Insurance to carriers regarding discrimination because of a covered person’s gender identity or expression. Specifically, the bulletin establishes that insurance carriers cannot deny, exclude or limit medically necessary health care services to covered persons due to gender identity or expression. This bulletin is based on discrimination provisions in the Nevada revised statutes and on Nevada Administrative Code. The Nevada revised statutes define gender identity or expression as “gender-related identity, appearance, expression or behavior of a person, regardless of the person’s assigned sex at birth.”
Although this is directed at insurers, it is important for Nevada employers to understand carrier actions that are not allowed.
