On May 5, 2017, Gov. LePage signed LD 6 into law, creating Chapter 44. Under the new law, insurers and pharmacy benefit managers (PBMs) may not impose copayments or other charges that exceed the prescription drugs’ claim costs. In addition, insurers and PBMs may not penalize pharmacy providers that provide plan participants with information relating to their out-of-pocket costs, the clinical efficacy of prescription drugs or alternative medications. The new law is effective Sept. 19, 2017.
