On March 30, 2015, Governor Daugaard signed SB 190 into law. The act requires all individual and group health insurance policies to provide coverage for applied behavior analysis for the treatment of autism spectrum disorders. The annual maximum benefit for such coverage must not be less than $36,000 for patients through age six, $25,000 for patients age seven through 13, or $12,500 for patients age 14 through 18.

The act also sets licensing requirements for professionals who perform applied behavior analysis and establishes the Applied Behavior Analysis Provider Workgroup, which will make recommendations regarding the certification and licensure of those professionals.

This act is effective the first plan year, policy year, or renewal date on or after Jan. 1, 2016.
