On Jan. 26, 2016, Gov. McAuliffe signed H 58 into law. The new law relates to the definition of “small employer” under Virginia law. Under the new law, as a result of the PACE Act, Virginia will retain the definition of “small employer” as an employer with an average of 50 or fewer employees. The PACE Act repealed a PPACA requirement that mandated states to define “small employer” as one with between one and 100 employees (and certain PPACA insurance mandates apply only to small employers). As a result of Virginia’s new law, those PPACA insurance mandates will not apply to small employer groups in Virginia. Employers with 51-100 employees should work with their carriers concerning next steps with regard to their contract or policy. The law is effective immediately.
