On Mar. 29, 2016, Gov. Tomblin signed HB 4046 into law. The law requires group accident and sickness insurers to provide abuse-deterrent opioid analgesic drugs alongside prescriptions for opioid painkillers. This law is aimed at providing safeguards to help prevent abuse while making sure patients have access to adequate pain control. Cost-sharing for the abuse-deterrent opioid analgesic may not exceed the lowest tier for brand name prescription drugs on the formulary. The law applies to policies issued on or after Jan. 1, 2017.
