On Mar. 25, 2016, Gov. Tomblin signed HB 4038 into law. This law prohibits insurers, including those that issue group accident and sickness policies and HMOs, that cover prescription topical eye medication from denying coverage for refills in certain conditions, including when: (1) The medication is to treat a chronic condition of the eye; (2) the refill is requested by the insured prior to the last day of the prescribed dosage period and after at least 70 percent of the predicted days of use; and (3) the original prescription indicates that refills are permitted and there are refills remaining. The law is effective June 10, 2016.
