On Oct. 13, 2015, the Oklahoma Insurance Department (OID) issued Bulletin No. LH 2015-02, which clarifies that the Small Employer Health Insurance Reform Act remains applicable to employers providing coverage to 2-50 employees. This clarification comes as a result of the PACE Act, which amended the PPACA to remove the provision that would have changed the definition of small group from 1-50 to 1-100. As such, states have the discretionary authority to define small group employer, and Oklahoma will continue to define small group as 2-50 employees.

Oklahoma health insurance issuers that previously filed rates reflecting the 1-100 small group employer definition may amend those rates with the OID.
