COVID-19 Insurance Update

On June 18, 2020, Insurance Commissioner Mulready amended LH Bulletin No. 2020-02, to make clear that provisions of previous versions of the bulletin will be rescinded on June 30, 2020, save for the provision that encourages the use of in-network telehealth and telemedicine services and encourage health insurers and entities to expand their networks of providers and facilities to perform telemedicine services.

The following provisions will not expire until the governor’s Executive Order No. 2020-20 (as amended) is withdrawn:

  1. The provision that requires the continued use of the timeframes for utilization review
  2. The provision that requires continued access to medically necessary diagnosis and treatment of COVID-19 without requiring preauthorization
  3. The provision that requires coverage without cost sharing for COVID-19 laboratory tests and for in-network provider office visits and in-network urgent care center visits when testing for COVID-19
  4. The provision that encourages companies to continue all reasonable measures to facilitate diagnosis and treatment of COVID-19

The extended grace periods provided to insureds under the original bulletin shall be allowed to expire upon reaching the end of the extension.

Finally, the suspension of underwriting rules related to minimum group participation requirements shall continue through December 31, 2020.

Employers with plans regulated by the state should be aware of these extensions.
