On May 11, 2015, Gov. Sandoval signed SB 217, creating Chapter 45. Chapter 45 amends Chapters 689A, B and C, 695 C and G and 639 of the Nevada Revised Statutes. Under the revisions, fully insured plans must provide coverage for topical ophthalmic products if otherwise covered by plans. In addition, plans must provide coverage when participants receive early product refills as follows:
21 days or more but before 30 days after receiving any 30-day supply,42 days or more but before 60 days after receiving any 60-day supply, and62 days or more but before 90 days after receiving any 90-day supply.
“Topical ophthalmic product” means a liquid prescription drug which is applied directly to the eye from a bottle or by means of a dropper. This is effective for fully insured plans providing coverage for prescription drugs issued or renewed on or after Jan. 1, 2016.
