On April 6, 2020, the Insurance Division of the Department of Business Regulation issued Insurance Bulletin Number 2020-5 to clarify that Executive Order 20-06 applies to all insurers, regardless of the type of insurance written.
As background, Executive Order 20-06 expands access to telemedicine by suspending the patient location requirement and the prohibition against audio-only telephone conversation (and the limitations on video conferencing). Further, the order provides that all medically necessary telemedicine services provided in-network must be reimbursed at rates not less than services provided in-person.
While this guidance impacts insurers, employers should be aware of these clarifications.
