On June 19, 2015, Gov. Abbott signed HB 966 into law, which created an optional HDHP plan for employees covered by the State of Texas Employees Group Benefits Act and their dependents. This legislation will allow state employees to open and contribute to HSAs if they enroll in the new HDHP plan option. The state will contribute the same amount toward coverage that they currently do under any of the other plan designs offered, except the lower premium for HDHP coverage will allow the state to contribute the difference in the form of an employer HSA contribution to the employee’s account. While the legislation is effective Sept. 1, 2015, the first opportunity for state employees to elect the new HDHP/HSA plan design will be for the plan year beginning Sept. 1, 2016.
