On June 16, 2015, Gov. Abbott signed HB 3028 into law. The legislation prohibits drug and discount health care programs from requiring a pharmacy to join a certain network as a condition of being paid. The law also prohibits a provider or provider’s employees from encouraging an individual from claiming a discount for prescription drugs under a discount health care program and prohibits discount programs from providing anyone with forms that could mislead an individual into thinking the program is health insurance coverage. Finally, the law amends the Texas Insurance Code to add a new section pertaining to the regulation of Discount Health Care Programs (Section 4151.154). The legislation is effective Sept. 1, 2015.
